Student Fitness:  By signing this agreement. Student represents warrants and insures that he has had an opportunity to observe the programs offered by the Business and that he is physically and mentally able to take classes offered by the business in that program and/or any other in which the student may participate. Student status is non-transferable.

Liability Waiver and Release:  The Student understands and agrees that strict observation of the Business’ rules and regulations and the rules and regulations relative to martial arts training, including the use of protective equipment, is required.  The Student understands and agrees that the use of the Business’ facilities and the Student’s presence at the Business’ facility are at the sole risk of the Student.  The Student understands and agrees that martial arts involved skills and training which include violent and sudden movements and that in connection with the training and instruction, there will be physical contact between instructors and students and between and among the Students and that such contact may result in personal injury to the Student, despite precautions taken to avoid such injuries.  Student hereby consents to engage in such contact as may be necessary or required by Student’s participation in the training program and/or classes.  Student, on behalf of him/herself and anyone claiming by or through the Student, hereby hold harmless, releases and forever discharges any employee, instructors, authorized representatives and Key Martial Arts from any liability, claim, loss including loss of property, damage, personal injury, or expense incurred by the Student and arising from the Student and arising from the Student’s execution of this agreement, payment processing, participation in any program offered by the Business, including, but not limited to, any injury or damage caused by the negligence or willful misconduct of Key Martial Arts, any employee, instructor, or authorized representatives.  The Student specifically understands and agrees he/she is assuming the risk of any and all injuries that he/she may suffer or incur as a result of his/her execution of this agreement and participation in any program offered by the Business.

Rules and Regulations: Student hereby agrees to follow any and all rules and regulations of the business at all times.  It is the discretion of the business to remove any student for failure of one or all of the rules and regulations provided to student.  It will be the responsibility of the student to pay the remainder of any and all tuition due the business from the time of removal to the end of the student’s contract.

Compliance with Laws:  This agreement shall be governed by the laws of the State of California in which the Business is located.  All rights and obligations of the Business and the Student are located.  All rights and obligations of the Business and Student under this agreement are subject to all applicable federal, state and local laws and regulations.  To the extent that the terms and conditions of this agreement conflict with any applicable statue, rule or regulation in effect at the time of execution of this agreement governing transactions of the type contained herein, the agreement shall be deemed revised to conform with such statues, rules and regulations.  The Business and the Student shall be bound by the modified agreement and agree that no other medications shall be enforceable unless in writing and signed by the parties.  This agreement constitutes the entire agreement between the parties and supersedes all prior agreements between the parties whether written or oral.  The invalidity or unenforceability of any provision hereof shall not affect the validity or enforceability of any other provisions.  The waiver of any breach shall not constitute a waiver of any subsequent breach of this agreement.

Health: I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell for the past 48 hours.

I hereby release and agree to hold Key Martial Arts LLC harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the salon, or that may otherwise arise in any way in connection with any services received from Key Martial Arts LLC. I understand that this release discharges Key Martial Arts LLC from any liability or claim that I, my heirs, or any personal representatives may have against Key Martial Arts LLC with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Key Martial Arts LLC. This liability waiver and release extends to the facility together with all owners, partners, and employees.
